Terms of service

These terms are the agreement between you and Overshot(“Overshot”, “we”) covering overshot.io and its services. By using Overshot, you agree to these terms. If you do not agree, do not use the service.

1. The service

Overshot is a research tool for short-form video marketing. It indexes public content and uses automated systems to identify trends, products, formats, and other marketing insights. Some parts of the service are available for free, while others require a paid subscription. Current plans and features are described on the pricing page.

We may improve, modify, add, or remove features over time. We do not guarantee that every feature or item of content will always remain available.

2. Accounts and eligibility

You must be at least 16 and legally able to enter this agreement where you live. If you use Overshot for an organization, you confirm that you have authority to bind it.

You are responsible for keeping your account secure and for activity under it. Account information must be accurate, and accounts may not be shared, transferred, or resold. Contact us promptly if you believe your account has been compromised.

3. Acceptable use

You may use Overshot for your own research and work for your clients. You may not:

• Scrape, crawl, harvest, or bulk-download the service or its content.
• Resell or redistribute our index, analyses, rankings, exports, or other data as a dataset, feed, API, or competing product.
• Circumvent plan limits, access controls, rate limits, or security measures.
• Interfere with the service, attempt unauthorized access, or use it in a way that harms Overshot or other users.
• Use the service to harass, dox, impersonate, or otherwise harm a creator.
• Use Overshot in violation of applicable law or another person's rights.

We may limit, suspend, or terminate access when we reasonably believe these rules have been violated.

4. Subscriptions, renewal, and cancellation

Paid plans, prices, billing periods, taxes, and included features are shown before you subscribe. Payments are processed by Stripe, and we do not receive or store your full card details.

Paid subscriptions renew automatically at the interval selected during checkout until cancelled. You authorize Stripe to charge the payment method on file for each renewal. Where required, we will send an advance renewal reminder.

You may cancel through your account. Cancellation takes effect at the end of the current paid billing period, and you retain paid access until then. Payments are generally non-refundable, though limited exceptions may be considered as described in our refund policy.

We may change prices or plan features. Any price increase affecting an existing subscription will be communicated in advance, and you may cancel before it takes effect.

5. Public and third-party content

Overshot indexes content published publicly by creators and information belonging to third parties, including product names, brands, and destination links. Their appearance in Overshot does not imply endorsement, partnership, or affiliation.

Creators and other rights holders retain ownership of their content. If you want content removed or believe your rights are being infringed, contact us with the relevant link and details. Overshot is not affiliated with TikTok or ByteDance and does not have access to private TikTok accounts or private TikTok data.

6. Intellectual property

Overshot and its software, design, analyses, classifications, rankings, and organization are owned by us or licensed to us. We grant you a limited, non-exclusive, non-transferable right to use the service while these terms apply.

Content you submit remains yours. You give us permission to process it only as needed to operate, secure, and support the service. Any exports remain subject to the restrictions in section 3.

7. Accuracy and availability

Overshot relies on public data, third-party services, automated analysis, and statistical methods. Results may be incomplete, outdated, unavailable, or incorrect. Metrics, classifications, product matches, links, and coverage can change, and we do not guarantee results for any particular category or use case.

The service is provided as is and as available, without warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or uninterrupted availability. Overshot does not provide business, financial, or legal advice, and you are responsible for decisions made using the service.

8. Limitation of liability

To the maximum extent permitted by law, Overshot is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, opportunity, data, or decisions made using the service.

Our total liability for any claim relating to Overshot is limited to the amount you paid us during the twelve months before the event giving rise to the claim.

Nothing in these terms excludes liability or consumer rights that cannot legally be excluded or limited.

9. Termination and changes

You may stop using Overshot or request account deletion at any time. We may suspend or terminate access for violations of these terms, risks to the service or other users, legal requirements, or discontinuation of the service.

We may update these terms. If a change is material, we will update the date above and provide additional notice when appropriate. Continued use after revised terms take effect means you accept them.

If any provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver of it.

10. Governing law and contact

Nothing in these terms removes consumer protections that apply where you live and cannot be contracted out of.
