This is where the case really narrows. The judge explains what criminal responsibility means. Because the question is not simply: Did Lindsay Clancy kill her children? The legal question is whether, because of a mental disease or defect, she lacked the substantial capacity to: appreciate the wrongfulness of what she was doing or conform her conduct to the requirements of the law. That is the fight. The defense says severe mental illness and psychosis destroyed her criminal responsibility. The Commonwealth says she still understood enough to know what she was doing and that it was wrong. So when you hear all of these experts arguing about planning, hallucinations, memory, timing, medication, behavior and intent… THIS is what they’re actually arguing about.
