Defense Says the Jury Note Points to One Holdout Ignoring the Court’s Instructions This jury note just made things even more intense. Kevin Reddington argued that the note indicates one juror is refusing to follow Judge Sullivan’s instructions on reasonable doubt — essentially digging in rather than applying the legal standard the court gave them. That is a much bigger issue than simply having one juror who disagrees with everyone else. A juror is absolutely allowed to disagree. A juror is absolutely allowed to vote differently. But every juror still has to deliberate under the law and the instructions given by the judge. Reddington raised the possibility of addressing that juror directly — including the question of whether that juror could continue serving. The Commonwealth pushed back and argued that Judge Sullivan’s reinstruction was enough, dismissing the idea that the juror should be replaced. Judge Sullivan ultimately brought the jury back to his instructions and again emphasized the proper reasonable-doubt standard. So now we have a jury that has already reported being deadlocked, received the Tuey-Rodriguez instruction, and is now sending a note that the defense says reflects one juror refusing to follow the court’s legal instructions.
