REDDINGTON: TWO JURY NOTES SAY HE HAS REASONABLE DOUBT BUT HE WON'T APPLY IT

This just got even more serious. Kevin Reddington told Judge Sullivan that this is not based on one jury note. He says there are TWO separate notes indicating that the holdout juror has acknowledged reasonable doubt — but is still refusing to apply that doubt according to the legal instructions the judge gave the jury. And Red’s argument was blunt. He said the juror told the court under oath that he could follow Judge Sullivan’s instructions. But according to Reddington, the notes now show the opposite. His words: “He lied under oath.” That is not the same as saying: “One juror simply disagrees with the other 11.” A juror is allowed to disagree. A juror is allowed to stand alone. But Red is arguing that this juror has recognized reasonable doubt and is refusing to apply the law that tells him what to do with that doubt. And if that is what these notes actually show? That is a completely different problem. This is why the defense is pushing so hard for Judge Sullivan to reassess whether this juror can continue serving.
