Today in History - February 19: Serial killer sues state for letting him out of prison Serial killer Nikko Jenkins sued the US state of Nebraska for wrongful release on February 19, 2014. Jenkins' argument in the multi-million dollar lawsuit was that he should have never been released from prison before he committed four murders. His handwritten lawsuit stated that prison officials should have known he was dangerous and shouldn't have been released. As a 16-year-old, Jenkins had been sentenced to 18 years behind bars over two armed carjackings after a series of other juvenile offences. During that time in prison, Jenkins told a psychiatrist he was hearing "voices from Egyptian gods". The psychiatrist concluded Jenkins was feigning psychosis. ment After 10 years behind bars, Jenkins was released from prison in July 2013. Less than two weeks later, Jenkins shot two strangers with a shotgun. In the following days, he murdered his third and fourth victims. Bataillon weighed whether to accept a motion Jenkins filed himself to dismiss his post-conviction relief case in Nebraska, while Jenkins’ attorneys argued the opposite. According to Judge Batallion, Jenkins filed the motion on Feb. 12, 2026. Defense attorneys argued the court should not consider the motion, saying Jenkins is not mentally fit. “For the last nearly 8 years, it has been the position of the state of Nebraska, relative to Mr. Jenkins, that he is not capable of making decisions regarding his health in general,” Defense Attorney David Tank sa Jenkins murdered four people in 2013 — a crime that put him on death row. Over the years, the victims’ families have called Jenkins an “attention seeker” and “pure evil.” While the death penalty is legal in Nebraska, the state lacks the drugs to carry out the sentence. For instance, pharmaceutical companies have refused to sell their drugs to be used for killing instead of healing. In March 2025, Jenkins wrote a letter to the courts asking that his appeals be stopped and that he be put to death. A month later, he appeared on video in court and retracted the request. A few months later in Aug. 2025, his legal team said his mental state is getting worse. They also noted he hasn’t had an IQ test in over a decade. Nikko Jenkins, 39, has been in custody since 2013.
