Districts across the country are facing budget cuts, staffing shortages, and difficult financial decisions. Those challenges are real. But a student’s disability related needs do not disappear because a district’s budget gets smaller. Under IDEA, an eligible student with a disability is entitled to a Free Appropriate Public Education designed to meet their unique needs. An IEP team must make decisions based on the individual student’s needs, not simply on what is cheapest, easiest to staff, or already available in the district. That means a district should not deny a necessary service, reduce service minutes, refuse needed supports, or change placement simply because providing what the student needs costs more money. The same principle applies under Section 504. Schools receiving federal financial assistance must provide eligible students with disabilities an appropriate education and cannot simply deny necessary supports because resources are tight. Can districts consider different ways to appropriately meet a student’s needs? Absolutely. Can they decide that a student no longer gets what they need to access their education simply because the budget was cut? No. Budget problems belong to the adults managing the system. They should not become barriers to a child’s education.
