First, the judge says plainly: An indictment is NOT evidence of guilt. Then he tells the jury exactly what Lindsay is charged with: Three counts of murder. And then comes the part people keep skipping: The Commonwealth bears the burden of proving beyond a reasonable doubt that Lindsay committed the crimes she is charged with AND that she was criminally responsible for her conduct. BOTH. So no — she did not walk into this courtroom already “guilty of the murders” with the jury only deciding criminal responsibility. She walked in charged with three murders and protected by the presumption of innocence. The Commonwealth still has to prove the charged crimes. AND ALSO prove criminal responsibility. That distinction matters. “Charged” is not “convicted.” An indictment is not proof. And criminal responsibility is not the only thing the Commonwealth has to establish.
