If you've ever copied and pasted a contract into ChatGPT or any AI tool to get a quick second opinion, then this is worth hearing. We are back to the hot topic of AI, and the UK courts are cracking down. Earlier this year, a UK tribunal ruled on this for the very first time. In a landmark UK tribunal case called Hamid, the UK tribunal confirmed that uploading confidential or legally privileged documents into a public open AI source tool can completely remove confidentiality and legal privilege. And the tribunal guidance was blunt. If you publish anything to an open AI tool, it will be treated as if you published it to the entire world. And just to be clear, that includes a draft contract or a dispute you're navigating or advice that your lawyer has given you. And here's the important point. It doesn't mean that every AI is off limits. You need to know the difference between a closed business tool and a public AI chatbot that just treats your contract as yet another prompt. If you're an entrepreneur, co-founder and you have questions about your business, your contract, your risk, drop me a DM.
