If you get sued for credit card debt, the debt collector is hoping you never file this one document. I'm Christie and for over 10 years I've helped people with credit and debt issues. When you're serve with the summons and complaint, the clock starts ticking. Most people panic or ignore it. That's exactly what the debt collector wants. Instead you need to file an answer with the court before your deadline. It starts with a general denial which tells the court the debt collector has to prove every allegation instead of you admitting them. It tells was a judge that you're fighting the lawsuit. It responds to each paragraph in the complaint and it raises your affirmative defenses. These defenses can require the debt collector to prove they actually own the debt. Prove they have the legal rights to sue you. Prove the balance is accurate. Prove they have the right documents. Preserve your right to arbitration and challenge whether they've even started a valid legal claim and those are just a few. A strong answer can include 16 different affirmative defense depending on the facts of your case. Without an answer, the deck collector can win by default.
