a debt collector just froze my bank account with a default judgment. What do I do? Is this... First take a breath. Cause you still have options to get the money back. Here's what happened behind your back. The debt collector filed a lawsuit, sent the paperwork to an old address, claimed you were served when you weren't, or served it to a different person other than you. So when you did not show up, the judge gave them an automatic win. That judgment in hand, they bypassed you completely, went straight to your bank and wiped out your bank account. Then they used the judgment to levy/freeze your account. To reverse this, you need to file one document with the clerk. It's called a motion to vacate default judgment. In that document, you tell the judge that you were not served properly or you had a valid reason for missing the court date. And then you also tell them you had a meritorious defense, which is a reason why you would have won had you shown up to court. If the judge vacates the judgment, the case reopens. If the judge grants your motion to vacate, then the judgment is wiped out, and you can reverse the garnishment. Now the collector may have to prove the case. In this way, you're back to and the debt collector actually has to prove their case against you. A lot of debt buyers don't have that evidence, so they just dismiss the case... and you WIN!
