The details on why Malcom Jamal Warner's Widow files a 1.27M lawsuit against his trust!

Malcom Jamal Warner was 26 years old, unmarried, no kids, when he established his revocable trust 30 years ago under the name the Warner Family Trust. His mom, Pamela Warner, was named the successor trustee at 70% with the remaining 30% split between his late father Robert Warner and his half-sister Collange Warner. That trust has not been touched nor revised in 30 years. Fast forward, he met his wife, now widow, Tanisha Warner in 2015. They have one child, 9-year-old McKenzie, and that's Malcom's only child. Malcom and Tanisha legally married on May 23rd, 2022, and one week prior to that, they established a prenup. In the prenup, Malcom spells out 5 specific promises: a $1 million life insurance policy naming Tanisha as sole beneficiary, a $5,000 monthly salary naming Tanisha as chief of staff for 39 months, which results in $195,000 in unpaid wages. $16,000 of tax-free money every year on their anniversary. And lastly, he promised to establish a college fund for their daughter McKenzie. And on July 20th, 2025, Malcom dies unexpectedly in a drowning accident in Costa Rica. So the issue is that Malcom had his own private estate, but it does not cover all of the promises that he made, which he did not fulfill before his untimely death. And over the last year, Tanisha and her mother-in-law have tried to reach a settlement to no avail. Which brings us to this lawsuit that she filed exactly one year from her husband's death on July 20th, 2026. The trust that Malcom established in 1996 was a revocable trust, but once he died, it reversed to an irrevocable trust, leaving all the power to his mom. A majority of Malcom's wealth is tied to that trust and not his personal estate. So Tanisha has filed that lawsuit against the trust as a creditor, claiming that she was owed that money because he promised it in the prenup and never delivered. Additionally, they have discussed that he wanted to update the trust and include her and the daughter. So that's the source of all the tension between Tanisha and her mother-in-law.
