Karmelo Anthony's Conviction will likely not be overturned

Karmelo Anthony's new defense team is unlikely to overturn his murder conviction. And here is why. Karmelo was found guilty of murder from a jury of his peers, people that lived in his community. They all thought that he committed murder. This is going to the circuit court and this time around there is no jury trial. This will be a panel of judges deciding Karmelo's fate. People who have been practicing law for over 50 years who have clerked for Supreme Court justices, some of the most elite, smartest lawyers on this planet. Standard of Review. During an appeal, the circuit court actually has a different standard of review. They're reviewing constitutional errors, abuse of discretion from the trial judge, and clear evidence of legal and sufficiency. This case and the evidence is pretty straightforward. Legal Insufficiency: not likely. We have a teenager who was stabbed to death at track meet. And we know who did it. We know that Austin pushed Carmelo and then Carmelo stabbed him. And we know that the next thing that happened was Carmelo stabbed him in the heart. Unless new evidence comes out that Carmelo was under psychosis, it's unlikely this will be overturned. Let's review the things that people mostly criticize about this trial. A jury of his peers. The argument that I often see is that one is entitled to a jury of their peers, and people online say that Carmelo was not given a jury of his peers because there were no black jurors. A jury of your peers does not mean a diverse panel of jurors that look like you. A jury of your peers means people from your community who are unbiased to make a decision. This is a constitutional argument. However, it'll be a high bar for the defense to prove. This is because the prosecution simply offered the reason why Carmelo did get a jury of his peers. Frisco is a majority white community and therefore Carmelo did get a jury of his peers. He wasn't in any danger and these are the type of people who live in that community. Ineffective Counsel. Unlikely. You should look at some examples of what ineffective counsel has looked like for a criminal case to be overturned. And I think in Texas they didn't even overturn a case where the attorney was sleeping at trial. Thoughts? I don't know guys, this is just my opinion. I don't think it's going to be overturned. And I think Carmelo Anthony supporters need to just let this go and get some accountability. And it's a hard one for him, but actions do have consequences.
