I watched day one of the Lindsay Clancy trial and took notes so we could break down the medical and legal issues together. The prosecution described her actions as deliberate and planned. The defense argued that her mental health had deteriorated, that bipolar disorder was missed, and that her medication treatment…including the use of SSRIs…may have worsened her condition. The jury also heard emotional testimony from Patrick Clancy, who became choked up while describing his children and the things they loved. The defense showed graphic photographs of Lindsay’s neck and wrist wounds and alleged that she ingested crushed pills before going out of the second-story window. Over the coming weeks, jurors are expected to hear from forensic experts, mental-health professionals, friends, family members and nurses who worked with Lindsay. The central question is not whether she k***** her children. The defense does not dispute that. The question is whether, at that exact moment, mental illness prevented her from understanding that what she was doing was wrong. Opening statements are arguments, not evidence.
