What's the difference between a debt collector suing you and an original creditor suing you in a debt lawsuit? That's a great question. The short answer is, one is a lot easier to handle than the other. But to understand the difference, you have to know what's going on behind the scenes. First, you have the original creditor. This is the company that you open the account with. You got the car loan from, or the bank that you applied for credit. When they sue you, they have everything. They have the original loan docs, they have all your payment history. They have everything. They have a mountain of evidence. Now let's talk about the debt collector. This is a third party company that buys the debt from the credit card company for pennies on the dollar. They buy it in great volume and they often don't have all that paperwork coming with the debt. And that's the biggest thing. To prove you have the legal right to collect the debt from you. And if they can't prove it, you win.
