It's already decided. The courts still take about 8% of your estate just to hand it over. On a 500 thousand dollar home, that's 40 thousand dollars gone. And it doesn't matter if there's a mortgage on it or not. That 8% comes off the gross value either way. Here's what rich families do instead. They put the home in a living trust and name their kids as the beneficiary. When you pass, the trust just continues. The home never touches probate. That alone saves your family roughly 8% of the estate. One more thing while you're at it. If there's still a mortgage on the property, get a term life policy that covers the balance.
