Everyone knows you should file an Answer when you're sued by a debt collector. But in the right case, there may be another document worth knowing about: a Motion to Dismiss. A Motion to Dismiss doesn't argue about whether you owe the debt. It argues that there's a legal reason the lawsuit shouldn't move forward. If there's a valid legal defect in the complaint, the judge may dismiss the case before it goes any further. It's not the right strategy in every debt lawsuit, but understanding the difference between an Answer and a Motion to Dismiss can help you better understand your options.
