If you're getting paid by TikTok or Instagram while you're in the United States, you better listen up because you could be violating your immigration status every time you make a post. Because if you're here on a tourist visa, a student visa, or some other status that doesn't authorize this work, you don't have a work permit, you don't have a green card, that monetized TikTok and Instagram is not a hobby, it's unauthorized employment. Now to be precise, there's no excuses. You can't say, "Well, TikTok or Instagram is depositing my money in Europe or Asia, so therefore it's not unauthorized employment." It has to do with where the work was done, not where the money's being deposited. So the question becomes: Were you in the United States filming videos, editing content? Brand deals. Posting affiliate links. Creating sponsored content. All of that could be unlawful employment. Because you're physically doing in the U.S. and getting paid for it by TikTok or Instagram. No matter where they're depositing that money. And by the way, free products, free hotel stays, sponsored trips. Affiliate commissions and all these other perks. They can potentially be unauthorized employment as well. And by the way, remote work is the same thing. Clocking into a freelancing, consulting, managing an overseas business from your couch in the U.S., from your hotel room in the U.S. That's unauthorized though the money's being deposited in a foreign bank account. And now immigration council officials, they're looking more closely at social media. Your videos, your sponsored trips, your brand tags, your affiliate links, it could all become evidence about what you're doing. You doing it? And if they entering the United States to continue working as an influencer on a tourist visa, on a student visa, on your ESTA. They're going to question really coming. As a tourist or as a student. And that could mean questioning at the airport, visa problems, denial of entry. Problems with future immigration applications. So when you monetize your social media or continue a remote job from the United States. You gotta actually figure out if you're legally allowed to work in the U.S. Because the worst time to learn whether you're right or wrong. Is after immigration denies your visa.
